Solutionize Tech, LLC (Delaware, USA), operating the Finsta platform ("Finsta")

1. Purpose and scope

This Policy describes how Finsta verifies the age and identity of creators, the age requirements applying to consumers, and the controls that prevent unverified persons from receiving payouts. It forms part of the Standards together with the Terms & Conditions, the Prohibited Content and Activity List, the Content Moderation Policy, the Complaints & Content Removal Policy and the Creator Consent & Media License. It applies to all accounts globally.

Verification is proportionate: identity checks are performed where the law and the card networks require them, they are carried out by an independent third-party identity verification provider rather than in-house, and no identity data is collected from a consumer who does not seek access to 18+ content.

3. Verification process for creators

Step 1 — Account creation

The applicant creates an account with email and phone verification and a date-of-birth affirmation. Timestamp, IP address, device identifier and app version are logged for every account event and retained.

Step 2 — Identity and age verification

Before any funds are released, the creator completes identity and age verification. Verification is handled by a third-party provider as part of its onboarding, under that provider’s own terms, privacy policy and regulatory obligations. It checks the creator’s identity, date of birth and ownership of the receiving account against a government-issued identity document, and may include a facial scan or other checks; what is collected is determined by the provider. Finsta does not operate the check and does not receive the identity documents or any biometric data collected in it; what Finsta receives is the outcome, the verified date of birth, and a reference and date for the check. A creator who does not complete and pass that verification is not paid.

In some cases — for example where a check cannot be completed through the provider — we may ask a creator to send documents to us directly through support. Documents received that way are held only for as long as needed to resolve the matter, as described in our Privacy Policy.

Step 3 — Contractual acceptance

Creators must affirmatively accept, by individual checkboxes, the Terms & Conditions and the Creator Consent & Media License. Acceptance events are recorded with timestamp, IP address and device identifier.

4. Biometric information

As part of the verification described in Step 2, the third-party provider may collect biometric data — for example a facial scan, and a biometric identifier derived from it, used to match the person to their identity document. What is collected is determined by that provider, under its own terms and privacy policy, and any notice or consent required for it is given by the provider at the time it is taken.

5. Consumers

Every consumer must be at least 18 years of age. At sign-up a consumer must confirm that they are 18 or over and accept the Terms & Conditions. Consumers cannot publish content on Finsta.

Further controls apply to every consumer account: the consumer app carries an age rating in the app stores through which it is distributed, and all user content sits behind an authenticated account with no public browsing.

6. Persons appearing in content

Our third-party identity verification provider verifies creators only. It does not verify, and holds no record of, any other person appearing in a creator's content. Responsibility for those checks sits with the uploading creator.

Under the Creator Consent & Media License, the uploading creator must, for every individual appearing in any content: verify that the individual is at least 18 years of age by inspecting a government-issued photo identity document and retaining a copy; and obtain and retain that individual's written consent covering the creation of the content and its distribution on Finsta. By uploading, the creator warrants that they hold those records.

Those records must be produced to Finsta within five (5) business days of a request. Content depicting a person whose age or consent cannot be evidenced on request is removed, related payouts are frozen, and the account is subject to termination. Depicted persons may withdraw consent and may seek removal at any time through Depicted-Person Appeals in Part B of the Complaints & Content Removal Policy, and, for intimate imagery published without consent, through the 48-hour removal process in that Policy.

7. Records

Finsta retains, for each creator: the outcome of the third-party verification, the verified date of birth, and the reference and date for that check; the creator's acceptance of the Terms & Conditions and the Creator Consent & Media License, with timestamp, IP address and device identifier; the creator's warranties regarding persons depicted; and any documentation the creator has produced to us. Identity documents and any biometric data collected during that verification are held by the third-party provider. Where a creator sends us a document directly through support, we hold it only for as long as needed to resolve the matter. Retention periods are set out in Section 7.1 of the Privacy Policy.
